          UPON hearing the counsel the Court made the following

                             O R D E R

1. This is a petition seeking bail.

2. Ms.   Swati   Ghildiyal,   learned   counsel   for   the respondent/State vehemently opposes the petition on the ground that   the   petitioner   has   criminal   antecedents   and   she   states that the earlier case was also a case under Section 302 of the Indian Penal Code.

3. It   is   informed   that   the   petitioner   has   been   incarcerated in   jail   for   a   period   of   almost   four   years.     Insofar   as   the earlier   case   is   concerned,   the   petitioner   has   already   been acquitted   of   the   charges   charged   with.     For   the   present   case

co-accused   Anas,   who   has   been   attributed   specific   role   of inflicting knife blow has already been granted bail.

4. In  that view  of the  matter, we  are inclined  to allow  the petition.

5. The   petitioner   is   directed   to   be   released   on   bail   in connection   with   FIR   No.I/108/2019   lodged   at   P.S.   Gayakwad Haveli, Ahmedabad, to the satisfaction of the Trial Court.

6. The special leave petition is, accordingly, disposed of.

7. Pending application(s), if any, shall stand disposed of.
