UPON hearing the counsel the Court made the following
O R D E R
Heard the learned senior counsel for the petitioner as also the learned senior counsel for the respondent-State and perused the petition papers. Though, contentions have been urged by the learned senior counsel for the petitioner to point out that the very confession
based on which the petitioner has been implicated, is not justified, considering that the trial in the matter is proceeding, we do not find it appropriate to express any opinion on that aspect 2 of the matter. However, in the present facts, we note that the petitioner has been in custody for nearly three years and it would take some more time for the trial to be completed. Therefore, taking into consideration all these aspects of the matter and making it clear
that the petitioner shall diligently participate in the trial, we deem it appropriate to grant bail to the petitioner. Hence, we direct that the petitioner be released on bail subject to appropriate conditions being imposed by the Trial Court. Ordered accordingly, Petition is accordingly, disposed of. Pending application(s), if any, shall stand disposed of.
