This is a third bail application moved by the applicant taccused Vikram Ashok Gaikwad, under section 438 of the Criminal Procedure Code for grant of anticipatory bail in connection with CR No.10/2022 registered with Sinnar Police Station for the offence under section 143, 147, 148, 326, 323, 504, 506, 427 r.w.s.149 of the Indian Penal Code (hereinafter referred to as “IPC” for short), in the event of arrest in connection with above referred crime on the same ground set out in the earlier bail application No. 101/2022, which was rejected by this court on 25.1.2022 and also bail application No. 165/2022 rejected by this court on 8.2.2022.

2. Heard, both the parties.

3. Perused the record. I.O. submitted his report and opposed the bail application.

By this application applicant­accused has come up with the case that the injured i.e. the first informant was assaulted by her husband and therefore, she suffered fracture injuries to her ribs and not by the alleged incident, on the basis of which the above referred crime is registered. In support of this argument, he filed on record the whatsapp chats in between the daughter of first informant with her relatives. However, the same cannot be considered, as at the most it can be considered at the time of defence of the present applicantaccused. Therefore, present bail application is devoid of merit. Hence, following order is passed.

O R D E R
1) Anticipatory Bail Application No.261/2022 is hereby rejected.

2) Inform the concerned police station accordingly.
