ORDER
This is an application for anticipatory bail under Section 438 of Cr.P.C. in relation with Crime No.54/2022 registered with Gorai Police Station for the offence under Sections 376 and 506 of I.P.C.
2.Perused the application and say of Investigation Officer. Prosecutrix present in the court. She appeared through Adv. Ms. Isha Punalekar.
4. Heard all the parties. The prosecutrix filed affidavit that she lodged the report under misunderstanding and misconception and now she has no objection to enlarge the applicant on anticipatory bail.
5.Keeping in mind the amicable settlement between the parties, I have considered the submissions of the learned advocate. It revealed from the record that the applicant and informant were dating with each other and they had consensual relations and further she has given no objection to enlarge the applicant on anticipatory bail. Considering the facts and circumstances, I think it would be proper to enlarge the applicant on anticipatory bail. I, therefore, pass the following order:
ORDER
1.The applicantVijay Manoj Gohil be released on anticipatory bail on executing personal bond in the sum of Rs. 15,000/ (Fifteen Thousand Rupees Only) with a surety in the like amount, in the event of his arrest in Crime No.54/2022 registered with Gorai Police Station for the offence punishable under Sections 376 and 506 of I.P.C., on the following conditions :
(i) He shall attend police station as and when called by the Investigation Officer, till filing of chargesheet.
(ii) He shall place on record his recent residential address proof and contact details.
2. Inform the concerned Police Station, accordingly.
3.Anticipatory Bail Application No. 1869/2022 stands disposed of, accordingly.
