:ORDER:

1.This is an application  under Section 438 of Code of Criminal Procedure   (hereinafter   referred   as   “Cr.P.C.”)   for   anticipatory   bail   on apprehension   of   her   arrest   in   connection   with   CR   No.325   of   2022 registered at Police Station, Sakinaka for the offences under Section 498­A, 377,   323,   504,   506(II)   r/w   34   of   the   Indian   Penal   Code   (hereinafter referred as ‘IPC’).

2.In   short,   informant   got   married   with   Hariom   Ramkrishna Mishra   on   20.11.2021   with   the   consent   of   both   the   families.   Present applicant­accused is sister­in­law of the informant.  It is alleged that after two   days   of   marriage,   applicant­accused   and   other   accused   started harassing   informant   physically   and   mentally   to   meet   their   unlawful demands.  Hence, report came to be lodged.

3.Prosecution filed say Exh.2 and resisted the application.

4.Heard Ld.Advocate Shri Sawant for the applicant­accused and Ld.Addl.PP   Shri   Ambekar   for   the   prosecution.   Perused   the   investigation papers. 

5.It is to be noted that all the allegation are of general in nature. Moreover,   already   all   other   co­accused including husband of informant was ordered to release on anticipatory bail on 29.4.2022 in Anticipatory Bail   Application   No.456/2022. Considering   vague allegations against applicant, there is no necessity of custodial interrogation.  Hence, I pass following order:
 

ORDER

1.Anticipatory   Bail   Application   No.1915   of   2022   is   hereby allowed.

2.In the event of arrest, applicant­accused Mrs. Ralka Sadanand Tiwari, in connection with CR No.325/2022, registered with Police   Station,   Sakinaka,   for   the   offences   punishable   under Sections 498­A, 377, 323, 504, 506(II) r/w 34 of Indian Penal
Code, she be released on executing PR Bond of Rs.15,000/­ (Rs.   Fifteen   Thousand   only)   and   the   like   amount   with   one surety.

3.Applicant­accused Mrs. Ralka Sadanand Tiwari shall report to the police station, Sakinaka on 11.12.2022 and 12.12.2022 in between 10.00 a.m. to 12.00 noon and shall co­operate to the Investigating officer as and when required.

4.Applicant­accused   Mrs.   Ralka   Sadanand   Tiwari  shall  not tamper with the evidence.

5.Anticipatory Bail Applications No.1915 of 2022 stand disposed off accordingly.
