ORDER
This is an application for anticipatory bail under Section 438 of Cr.P.C. arising out of Crime No.1016/2022 registered with Goregaon Police Station for the offence punishable under Section 452, 323, 504 and 506 r/w Section 34 of I.P.C.
2. Perused the application and say of Investigation Officer.
3. Heard Adv. Mr. Aakash Sharma for the applicant and APP Mr. Shailesh Pachapohar for the prosecution.
4.I have carefully gone through the FIR. Considering the accusations made in the FIR, I don’t find any necessity for custodial interrogation of the applicant. Moreover, one of the accused is arrested and released on bail by the concerned Magistrate. In such circumstances, the applicant is entitled for anticipatory bail in the event of his arrest. I, therefore, pass the following order :
ORDER
1.The applicantNadar Antroo Babudurai be released on anticipatory bail on executing personal bond in the sum of Rs.15,000/ (Fifteen Thousand Rupees Only) with one or two sureties in the like amount, in the event of his arrest in Crime No.1016/2022 registered with Goregaon Police Station for the offence punishable under Sections 452, 323, 504 and 506 r/w 34 of I.P.C., on the following conditions :
(i) He shall attend police station as and when called by the Investigation Officer by issuing notice.
(ii) He shall not tamper with the prosecution evidence.
(iii) He shall not travel abroad, without prior permission of the Magistrate
(iv) The Investigation Officer is directed to acknowledge the presence of the applicant, if he attends police station.
2.Inform the concerned Police Station, accordingly.
3.Anticipatory Bail Application No. 1875/2022 stands disposed of, accordingly.
