Mumbai Man Nilesh Vinod Ghadge Denied Bail in Scooter Theft Case

Mumbai, February 8, 2022 – Nilesh Vinod Ghadge, a 21-year-old service worker, has been denied bail by the Sessions Court for Greater Bombay in connection with a scooter theft case. Additional Sessions Judge M.G. Deshpande (Court Room No. 16) rejected the bail application on February 8, 2022.

Ghadge was arrested in connection with C.R. No. 5/2022, registered at the Vakola Police Station, under Section 379 of the Indian Penal Code (IPC) (theft).

Background and Allegations:

The case was initiated by Keeth Boscow Jesinto, who reported that his Active 5G scooter, bearing registration number MH02-FH-9426, was stolen on January 1, 2022. Jesinto had parked his scooter in front of Vihar Hotel, Kalina, Santacruz, while attending a friend’s function. Upon returning, he discovered that his scooter was missing.

During the investigation, Ghadge’s involvement was revealed. He provided a discovery statement that led to the recovery of the stolen scooter. Ghadge was arrested on January 20, 2022, and the investigation is ongoing.

Arguments Presented:

Mr. Mangesh Pawar, representing Ghadge, applied for bail. However, Additional Public Prosecutor (APP) Rashmi Tendulkar strongly opposed the application, citing the facts alleged in the FIR, the possibility of Ghadge repeating the crime, and the likelihood of him absconding.

Court’s Reasoning and Decision:

Judge Deshpande, after hearing both sides, determined that Ghadge had not made a strong prima facie case for bail. The court noted that Ghadge’s statement under Section 27 of the Indian Evidence Act prima facie pointed to his involvement in the alleged offense.

The court emphasized the increasing prevalence of two-wheeler thefts in Mumbai and the necessity for a thorough investigation to achieve finality. It expressed concerns that granting bail could lead to Ghadge pressuring prosecution witnesses and hindering the investigation’s progress.

Order Issued:

The court rejected Ghadge’s bail application, concluding that he had failed to establish a strong prima facie case for release. The order was signed on February 8, 2022, and uploaded on the same day.

This decision underscores the court’s concern over the rising incidents of vehicle theft and its commitment to ensuring a thorough investigation. The court prioritized the integrity of the investigation and the safety of witnesses over the accused’s plea for bail.
