Mumbai, Maharashtra – May 6, 2022 – Anwar Jalil Qureshi, accused of stealing a mobile phone from a commuter on a local train, has been granted bail by the Sessions Court for Greater Bombay. The court, presided over by Additional Sessions Judge R.M. Sadrani, granted bail, ordering Qureshi to deposit a cash surety of Rs. 10,000 and report weekly to the Wadala Railway Police Station.
Qureshi was arrested on March 24, 2022, in connection with C.R. No. 203 of 2022, registered at the Wadala Railway Police Station, for an offense under Section 379 of the Indian Penal Code (IPC), which pertains to theft.
Background of the Case:
The complainant, Samir Amar Dawada, reported the theft of his mobile phone while traveling on a local train. Following an investigation, Qureshi was identified and arrested, and the stolen mobile phone was recovered from him.
Arguments and Court’s Decision:
Advocate Vijay Agale represented Qureshi, while APP Abhijeet Gondwal represented the State. After considering the arguments and the circumstances of the case, Judge Sadrani granted Qureshi’s bail application under Section 439 of the Code of Criminal Procedure (Cr.P.C.).
The court noted that the maximum punishment prescribed for the offense under Section 379 of the IPC is three years. Considering the period Qureshi had already spent in custody and the nature of the offense, the court found it appropriate to grant bail.
Bail Conditions:
The court granted bail to Qureshi subject to the following conditions:
- Qureshi must execute a Personal Recognizance (P.R.) bond of Rs. 10,000 with one surety of the same amount.
- He must deposit a cash surety of Rs. 10,000.
- He must provide his detailed address and phone number at the time of furnishing bail.
- He must furnish the bail before the Court attending remand.
- He must attend the Wadala Railway Police Station every Monday between 11:00 AM and 2:00 PM until further orders.
- He must not directly or indirectly influence any person acquainted with the facts of the case.
- He must not leave India without prior permission from the court.
Outcome:
The court’s decision reflects a balance between the accused’s right to liberty and the need to ensure his presence during the trial. The imposition of a cash surety and the requirement to report weekly to the police station are intended to ensure Qureshi’s compliance with the court’s orders and prevent any potential obstruction of justice. The decision also shows that the courts consider the length of possible jail sentences, when deciding on bail.
