Mumbai Court Grants Provisional Cash Bail to Mariyam Amma Madhavi Abdul Rehman Shaikh 50-Year-Old Woman

Mumbai, Maharashtra – April 30, 2022 – The Sessions Court for Greater Mumbai has granted provisional cash bail to Mariyam @ Amma @ Madhavi Abdul Rehman Shaikh, a 50-year-old woman. Additional Sessions Judge Sonali P. Agarwal (C.R. No. 41) allowed the application (Exh. 3) for provisional cash bail in Criminal Bail Application No. 865 of 2022, related to C.R. No. 195 of 2022 registered with Ghatkopar Police Station.

Case Background:

Mariyam @ Amma @ Madhavi Abdul Rehman Shaikh, 50, was granted bail in Criminal Bail Application No. 865 of 2022. She subsequently filed an application (Exh. 3) seeking provisional cash bail.

Arguments and Court’s Reasoning:

Advocate Rajesh Singh represented the applicant, Mariyam Shaikh. APP Meera Choudhary-Bhosale represented the State.

The prosecution objected to the grant of provisional cash bail.

The court, after considering the submissions, noted that Mariyam Shaikh was a 50-year-old woman and, as per her counsel, was residing in Mumbai. “Accused is 50 years old lady. It appears, as per the contentions of learned counsel for accused, accused is staying in Mumbai,” Judge Agarwal stated.

The court also noted that a bail order had already been passed in her favor. “The bail order is passed in favour of accused,” Judge Agarwal noted.

Considering these circumstances, the court deemed it proper to grant provisional cash bail for a short duration. “Considering such circumstances, it will be proper to release accused on provisional cash bail for short duration,” Judge Agarwal concluded.

Decision:

Judge Agarwal allowed the application (Exh. 3) and granted provisional cash bail to Mariyam @ Amma @ Madhavi Abdul Rehman Shaikh for ₹30,000 for a period of 60 days.

The certified copy of the order was issued on April 30, 2022. This decision highlights the court’s consideration of the applicant’s age, residence, and the prior grant of bail when allowing provisional cash bail.
