Mumbai Court Grants Bail to Yasmin Shahbaz Rubab Sayyed in Extortion and Assault Case, Citing Completion of Investigation

Mumbai, May 19, 2022 – The Additional Judge G.B. Gurao granted bail to Yasmin Shahbaz Rubab Sayyed, accused in an extortion and assault case registered at Deonar Police Station. The court cited the completion of the investigation and the filing of the charge sheet as reasons for granting bail.

Sayyed was arrested in connection with Crime No. 9/2022, registered under Sections 307 (attempt to murder), 386 and 387 (extortion), 143, 144, 148, and 149 (unlawful assembly and rioting) of the Indian Penal Code (IPC), Sections 3, 4, 25, and 27 of the Arms Act, and Section 37(1)(a) and 135 of the Maharashtra Police Act.

According to the prosecution, Sayyed and others forcibly recovered “Hafta” (protection money) from shop owners in the area. The complainant’s father, who runs a shop in the area, was also a victim. The incidents occurred on January 4 and 5, 2022, and Sayyed was alleged to have caused injuries to witnesses.

Sayyed, through her advocate Vishal A. Bhogle, sought bail under Section 439 of the Criminal Procedure Code (CrPC), arguing that she was innocent, the injured person was treated as an outpatient, and the charge sheet had been filed, making further custodial interrogation unnecessary.

The prosecution, represented by Additional Public Prosecutor (APP) Ramesh Siroya, opposed the bail, arguing that the offense was serious and Sayyed would pressurize witnesses if released.

Judge Gurao, after perusing the charge sheet, noted that the investigation was complete and the charge sheet had been filed.

“However, in the present case, investigation is completed and charge­sheet is filed. Further custody of accused is not necessary.” Said Judge Gurao.

Considering the facts and circumstances of the case, the court found that Sayyed was entitled to bail.

Consequently, the court granted bail to Sayyed, ordering her to execute a personal bond of Rs. 25,000 with one or more sureties of the same amount. The court also imposed the following conditions:

  • Sayyed must attend court hearings regularly unless exempted.
  • Provisional cash bail of Rs. 25,000 was allowed for four weeks.

“Applicant/accused namely Yasmin Shahbaz Rubab Sayyed, in C.R.No.9 of 2022 registered with Deonar police station for the offence punishable under Sections 307,386,387, 143,144,148,149, of IPC and section 3,4,25 & 27 of Arms Act r/w section 37(1) (a),135 of Maharashtra Police Act , shall be released on her executing PR Bond of Rs.25,000/- (Twenty Five Thousand only) with one or more sureties of the like amount on the conditions that :­ a) She shall attend the dates of hearing regularly unless exempted by the court. She be released on provisional cash bail of Rs.25,000/-. Duration of provisional cash bail shall be for four weeks.” Judge Gurao ordered.
