Mumbai Court Grants Bail to Sandeep @ Vinod Ramjiyavan Rajbhar Accused with Extensive Criminal Record in Extortion Case, Imposes Strict Conditions

Mumbai, May 18, 2022 – The Additional Sessions Judge R.M. Sadrani granted bail to Sandeep @ Vinod Ramjiyavan Rajbhar, an accused with a significant criminal history, in an extortion case registered at Wadala Police Station. The court, while granting bail, imposed strict conditions, including a ban on entering the Wadala area.

Rajbhar was arrested in connection with Crime No. 128/2022, registered under Sections 385 (putting person in fear of injury in order to commit extortion), 504 (intentional insult with intent to provoke breach of the peace),1 and 506 (criminal intimidation) of the Indian Penal Code2 (IPC).

According to the prosecution, on April 20, 2022, Rajbhar allegedly demanded Rs. 20,000 from the complainant, Amirull Hasan Khan @ Babu, who runs a sand extraction and selling business. Rajbhar allegedly threatened to kill Khan if he failed to pay the amount.

Rajbhar, through his advocate Nathabhau Paithane, sought bail under Section 439 of the Criminal Procedure Code (CrPC).

The prosecution, represented by Additional Public Prosecutor (APP) Abhijeet Gondwal, opposed the bail, citing Rajbhar’s extensive criminal record, which included 28 registered crimes since 1998. They also highlighted that Rajbhar had a “terror” in the Wadala locality.

Judge Sadrani, after considering the submissions, noted that except for Section 506, the other offenses were bailable. He also acknowledged Rajbhar’s arrest on April 20, 2022, and his significant criminal antecedents.

“Applicant is having terror in Wadala locality and 28 crimes are registered against him since 1998 onwards. Considering the nature of offence, punishment prescribed for the offence and criminal antecedents of the applicant, I am inclined to allow the application,” Judge Sadrani stated in his order.

Consequently, the court granted Rajbhar bail, ordering him to execute a personal bond of Rs. 50,000 with one or more sureties of the same amount. The court also imposed the following strict conditions:

  • Rajbhar must furnish his detailed address and phone number at the time of furnishing bail.
  • Rajbhar must not enter the Wadala area until further orders.
  • Rajbhar must not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case.
  • Rajbhar must not leave India without prior court permission.
  • In case of breach of any conditions, the prosecution is entitled to move an application for cancellation of bail.

“Applicant Sandeep @ Vinod Ramjiyavan Rajbhar in C.R.No.128 of 2022 of Wadala Police Station, Mumbai for the offence punishable U/s.385, 504, 506 of Indian Penal Code be released on bail on executing PR bond of Rs.50,000/- with one or more sureties of the same amount. Applicant to furnish his detailed address, phone number at the time of furnishing bail. Applicant shall not entered into Wadala area till further orders. Applicant shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the accusation against himself so as to dissuade him from disclosing such facts to the Court or to any police officer. Applicant shall not leave India without previous permission of the Court. In case of breach of any conditions, prosecution is entitled to move application for cancellation of bail,” Judge Sadrani ordered.
