Mumbai, January 11, 2024: A Sessions Court in Mumbai has granted bail to 24-year-old Rishikesh Rajendraprasad Sahani, a student accused of assault, in connection with Criminal Case No. 228/2023 registered at the Sewree Police Station. The bail order was passed by Additional Sessions Judge Rajesh A. Sasne on January 10, 2024, in Court Room No. 30.
Case Background
According to the prosecution, Sahani allegedly assaulted the complainant using a bamboo stick, striking blows on the victim’s head and hand, resulting in bleeding injuries. Following the incident, a case was registered under Sections 323 and 326 of the Indian Penal Code (IPC), leading to Sahani’s arrest on November 13, 2023.
Sahani, who has been in judicial custody since his arrest, moved a bail application under Section 439 of the Criminal Procedure Code, asserting that he was falsely implicated. His defense argued that there was no need for further custodial interrogation as all necessary recoveries had been made. Additionally, it was brought to the court’s attention that Sahani is an HIV patient, with supporting medical documentation submitted along with the bail application.
Prosecution’s Opposition
The prosecution strongly opposed the bail plea, citing concerns that Sahani might tamper with evidence or intimidate witnesses if released. The prosecution also argued that since the investigation was still underway, his release could hamper the collection of crucial evidence.
Court’s Observations and Order

- Sahani shall be released on bail upon furnishing a personal bond and surety bond of Rs. 25,000/- with one or two sureties.

- He must report to the concerned police station on the 1st and 4th Saturday of each month until the filing of the charge sheet.
- A provisional cash bail of Rs. 25,000/- was granted, which must be replaced with a surety within four weeks of his release; failure to do so would result in forfeiture of the cash bail.
- He shall not leave India without prior permission from the court.
- Bail formalities shall be completed before the concerned magistrate.
