Mumbai, February 21, 2024: The Additional Sessions Judge, Shri A.S. Salgar, of the City Civil & Sessions Court, Greater Mumbai, granted bail to Lenin Jorge Nadar, who was arrested under the Arms Act and Maharashtra Police Act. The bail was granted in connection with C.R. No. 57/2024 registered at Chunabhatti Police Station.
Case Background
Nadar was arrested on February 2, 2024, after allegedly being found in possession of a country-made pistol near Chatrapati Maidan, Chunabhatti, Mumbai. A case was filed against him under Sections 3 and 25 of the Arms Act, along with Sections 37(1)(A) and 135 of the Maharashtra Police Act.
Court’s Observations
During the bail hearing, Nadar’s defense, represented by Advocate Tabish Mooman, argued that he was falsely implicated and that the investigation was complete, leaving nothing more to be recovered from him. The prosecution, represented by APP Rakesh Tiwari, opposed the bail, stating that the seized weapon was still under forensic examination and that Nadar could tamper with evidence.
However, the court noted that the weapon had already been seized, no further recovery was required, and Nadar had no prior criminal record. Given these circumstances, the judge ruled in favor of granting bail.
Bail Conditions
The court allowed Nadar’s release on a personal bond of Rs. 15,000 with a surety of the same amount. Additionally, he must:
- Report to Chunabhatti Police Station every Monday between 11:00 AM and 2:00 PM until the charge sheet is filed.
- Provide his residential address, mobile number, and email to the investigating officer.
- Not tamper with evidence or influence witnesses.
- Not leave India without prior court permission.
- Face bail cancellation if any conditions are violated.
