Mumbai, Maharashtra – August 11, 2022 – Zubair Wahid Ali Khan, a 39-year-old businessman from Mumbai, has been granted bail by the Sessions Court for Greater Bombay in connection with an appeal against a lower court’s judgment. The order, issued by Additional Sessions Judge K. P. Shrikhande on August 6, 2022, allows Khan’s release upon furnishing a personal bond and surety of ₹40,000.
The case originates from a judgment and order dated December 23, 2021, passed by the Metropolitan Magistrate, 20th Court, Mazgaon, Mumbai, in C.C. No.2001591/SS/2015. Khan, aggrieved by this ruling, filed a criminal appeal along with a bail application (Bail Application No. 814 of 2022) before the Sessions Court.
During the hearing, Adv. S. R. Gaud represented the appellant, Zubair Wahid Ali Khan, while APP Mr. Ajit Chavan appeared for the respondent, the State of Maharashtra. The court, after reviewing the case materials, noted that the sentence imposed by the lower court had already been suspended. This suspension of the sentence provided sufficient grounds for the Sessions Court to grant bail to Khan.
“Heard respective parties. Perused the materials on record. It is appearing that being aggrieved by the judgment and order dated 23.12.2021 passed by the learned Metropolitan Magistrate, 20th Court, Mazgaon, Mumbai in C.C. No.2001591/SS/2015, the appellant-accused filed the appeal alongwith the present bail application,” stated Judge Shrikhande in the order.
The court further emphasized that “The sentence imposed by the judgment and order dated 23.12.2021 in C.C. No.2001591/SS/2015 by the learned Metropolitan Magistrate, 20th Court, Mazgaon, Mumbai is already suspended and therefore, I find sufficient ground to allow the application.”
In the formal order, Judge Shrikhande directed Khan’s release upon executing a personal bond and surety bond of ₹40,000. Additionally, a provisional cash bail of ₹40,000 was granted for a period of one month from the date of the order.
The order concluded with the disposal of Bail Application No. 814 of 2022. The certified copy of the judgment was issued on August 11, 2022, and was confirmed to be a true and correct copy of the original signed order.
