Mumbai, January 29, 2022 – The Sessions Court in Mumbai has granted bail to Indian Navy officer Kalyan Krishna Chaki, who was accused in connection with the death of his wife. The case, registered under Crime No. 387/2021 at Cuff Parade Police Station, charged Chaki under Sections 304(B), 306, 323, 504, and 506 read with 34 of the Indian Penal Code (IPC).
Case Background
The prosecution alleged that Chaki, along with other co-accused, subjected his wife to mental and physical cruelty, which led to her suicide. Following an investigation, a charge sheet was filed, leading to his arrest and subsequent detention at Arthur Road Jail.
Arguments by Defense and Prosecution
Chaki’s defense, represented by Advocate Prasad Panchal, contended that he was falsely implicated in the case and had no intention to provoke his wife to take such an extreme step. He further asserted that there were no disputes between them and sought bail on the grounds of his service in the Indian Navy and lack of prior criminal records.
The prosecution, represented by Additional Public Prosecutor (ADPP) Meera Choudhary-Bhosale, opposed the bail plea, arguing that Chaki’s release could lead to potential threats to witnesses and the informant. Additionally, the prosecution cited concerns that he might abscond, given his roots in West Bengal.
Court’s Decision
After hearing arguments from both sides, Additional Sessions Judge Sonali P. Agarwal, presiding over Court Room No. 41, noted that the charge sheet had already been filed and the trial would determine Chaki’s culpability. The court acknowledged that the accused had no prior criminal history and, considering the circumstances, decided to grant bail with stringent conditions.
Bail Conditions
As per the court’s order dated January 28, 2022, Chaki was released on bail upon furnishing a personal bond (PB) and surety bond (SB) of Rs. 15,000 each. The following conditions were imposed:
- The accused must not threaten or cause harm to the informant.
- The accused must not tamper with the prosecution’s evidence.
- The accused must not leave India without prior court permission.
- The accused must not influence witnesses in any manner.
- The accused must provide his mobile number and all residential addresses (permanent, temporary, and postal) to the investigating officer and must not change his contact details without informing authorities.
Legal Implications
The case is a significant development in the judicial process concerning allegations of abetment to suicide and domestic abuse. Legal experts suggest that while bail has been granted, the trial will be crucial in determining the final outcome.
Conclusion
The case is now set to proceed to trial, where the evidence and testimonies will be examined to determine Chaki’s role in the alleged crime. Meanwhile, the accused remains under judicial watch with strict conditions to ensure compliance with the court’s directives.
