Mumbai, February 12, 2024 – In a significant ruling by the Sessions Court, the application for bail submitted by four individuals involved in a criminal case against Jumbo Electronics Corporation was accepted. The applicants, Dayal Infotainment and three individuals—Nupur Saxena, Rachna Saxena, and Sundeep Saxena—were convicted in January 2024 by the Metropolitan Magistrate, 7th Court, Dadar, Mumbai, for their involvement in a case under C.C. No. 1603/SS/2016. The appeal against their conviction was lodged shortly after the decision.
The bail application was heard by Additional Sessions Judge S.P. Pingle, who reviewed the arguments put forth by the applicants’ counsel, Mr. Sunil D’Souza. D’Souza contended that there were strong grounds for success in the appeal and that the applicants had been out on bail throughout the trial, with no prior history of absconding or failure to appear.
The judge, after considering the arguments, acknowledged the applicants’ intent to challenge the legality of the conviction and agreed to suspend the substantive sentence. However, the applicants were directed to pay 20% of the total cheque amount involved in the case as part of the bail conditions.
Key Conditions of the Bail:
- Nupur Saxena, Rachna Saxena, and Sundeep Saxena were each granted bail on furnishing personal bonds (P.B.) and surety bonds (S.B.) of Rs. 1 lakh each.
- The applicants are required to attend all dates for the ongoing appeal without fail. If they miss any hearings without prior, justified reasons, their bail will be canceled.
- If they are unable to attend due to genuine reasons, they must notify the court in advance to avoid any consequences.
The decision of the court is seen as a significant development in the case, as the applicants will now have the opportunity to present their arguments in the appeal while remaining free on bail.
