Businessman Gyandev Shripati Navghane Granted Bail in Assault Case by Sessions Court

Mumbai, July 29, 2022: The Sessions Court for Greater Mumbai has granted bail to businessman Gyandev Shripati Navghane, who was arrested in connection with an assault case registered at Dadar Police Station under C.R. No. 448/2022. The court, presided over by Additional Sessions Judge S.D. Kulkarni, issued the bail order on July 27, 2022, following arguments from both the defense and the prosecution.

Case Background Navghane, a 46-year-old businessman residing in Chembur, was arrested on July 2, 2022, in connection with charges under Sections 326 and 324 of the Indian Penal Code (IPC), which pertain to voluntarily causing grievous hurt by dangerous weapons or means. Initially, he was placed in police custody, but since July 4, 2022, he had been in judicial custody.

Court Proceedings and Arguments During the bail hearing, Navghane’s counsel, Advocate Vijay P. Agale, contended that his client had been in custody for an extended period and that the investigation was nearly complete. He further pointed out that the accused had already undergone police interrogation and that there was no necessity for his continued detention. Additionally, a cross-case had been filed against the accused, indicating the involvement of multiple parties in the incident.

The prosecution, represented by Assistant Public Prosecutor Mr. Lade, opposed the bail application, highlighting the severity of the charges. However, the prosecution admitted that the weapon used in the alleged assault had already been recovered from the crime scene and that witness statements had been recorded. The prosecution also confirmed that no individual involved in the case had required prolonged hospitalization, as all injured parties had been discharged soon after receiving medical treatment.

Court’s Ruling Considering the arguments from both sides, Judge Kulkarni observed that since the investigation was nearly complete and the accused’s custodial interrogation was no longer required, there was no justification for keeping him incarcerated for an indefinite period. Based on these considerations, the court granted bail to Navghane under the following conditions:

  1. The accused was required to furnish a personal bond (P.B.) and surety bond (S.B.) of ₹25,000 with one or two sureties.
  2. He was prohibited from tampering with prosecution witnesses or evidence.
  3. He was directed to report to the Dadar Police Station every Sunday between 7:00 p.m. and 9:00 p.m. until further orders.
  4. He was granted provisional cash bail in the same amount, with the condition that he furnish sureties within four weeks. Failure to do so would result in the forfeiture of the cash bail without further orders.
  5. He was restricted from leaving India without prior court permission.
  6. The bail formalities were to be completed before the trial court.
