Mumbai, February 9, 2024 – The Sessions Court for Greater Mumbai has issued a ruling on the bail application of Firoz Mustak Khan and Sohel Mustak Khan, accused in a case registered under C.R. No. 22/2024 at Trombay Police Station. The bail plea was partially granted, allowing the release of Firoz Mustak Khan while denying bail to Sohel Mustak Khan.
The case pertains to an alleged assault incident on January 17, 2024, when Sohel Mustak Khan reportedly attacked the informant with a knife after being denied a free packet of cigarettes. The victim sustained an injury to his right-hand finger while attempting to defend himself. Meanwhile, Firoz Mustak Khan was accused of biting the victim’s brother on the shoulder and stealing Rs. 5,000 from their house. The accused were arrested on the same day.
During the hearing, the defense, led by Advocate Harikesh Pandey, argued that both accused had been falsely implicated and that the injuries sustained by the victim were minor. The prosecution, however, contended that the accused were habitual offenders and could potentially intimidate witnesses if released.
After reviewing the case details, Additional Sessions Judge A.S. Salgar ruled that the allegations against Firoz Mustak Khan were limited to physical assault and theft, with no evidence suggesting attempted murder or the use of a weapon. As a result, he was granted bail upon furnishing a personal bond of Rs. 30,000 with sureties, along with conditions such as reporting to the Trombay Police Station twice a week and refraining from influencing witnesses.
Conversely, the court found significant material against Sohel Mustak Khan, indicating his active involvement in the assault using a deadly weapon. Considering the severity of the charges, including an alleged attempt to murder, the bail application for Sohel Mustak Khan was rejected.
The case continues as further investigations proceed, with legal proceedings expected to take time before reaching a final judgment.
