Accused no. 1 Yasin and accused no. 2 Jishan have
preferred this application U /Sec. 439 of CrPC for bail in Crime
No. 55 / 2022 registered U / Sec. 379 read with Sec. 34 of IPC.
Perused record. Heard Learned counsel Shri Abhijit Kale for
applicant / accused, Learned APP Smt. Aparna Patil for the State
and IO Police Constable Shri Rohidas Sonar. Perused say of IO.

After accused were taken into MCR, they preferred
application before Learned ACJM on 01.05.2022 (Remand
Court) for their release on bail. Same was rejected by the Learned
ACJM, Nashik, on 01.05.2022. Thereafter, on 05.05.2022
accused moved application for review of said Order. The Learned
In-charge JMFC, Nashik, vide Order Dt. 09.05.2022, rejected the
same.
Hence, through present application, accused persons
have prayed for released on bail.

Prosecution opposed application on the ground that both
the accused are habitual in committing theft of motorcycles and
hence total number of 3 Crimes are registered against them as
Crime No. 56/2022, 88/2022 (Mumbai-Naka Police Station),
Crime No. 74/2022 and 96/2022 (Upnagar Police Station,
Nashik). It was also argued that investigation is in progress,
accused might have tamper with prosecution evidence. Hence,
application be rejected.

Conclusion :

Though, numerous crimes of similar nature are
registered against the accused persons, however, they are in jail
since 30.04.2022 and are not required for investigation.
Considering both aspects, it will be proper to release the accused
on bail, by imposing stringent conditions. Hence, following order
is passed.
ORDER
1. Application is allowed.
2.

Accused No. 1 Yasin Firoz Shaikh and accused No. 2
Jishan Sabbir Shaikh, each be released on furnishing PR
Bond of ₹. 15,000/- and one surety in like amount, on
following conditions :
i.

They shall attend concern Police Station at 11:00
AM, on every Wednesday and Saturday, till filing
of the Charge-sheet.

ii.

Accused persons
investigation.

shall
co-operate
in
the
iii. They shall not directly or indirectly make any
inducement, threat or promise to any person
acquainted with the facts of the case so as dissuade
that person from disclosing such facts to the Court
or to any police officer.

iv. They shall furnish their identity proof, proof of
their current and permanent residence and mobile
number/s to the IO.

They shall inform the IO / Court, if they change
their addresses.

Bail before the Learned Trial Court.
