This
application
has
been
filed
by
the
applicant/accused under section 438 of Cr.P.C. for releasing
them on anticipatory bail in the event of their arrest in the
aforesaid Crime registered at Mumbai Naka Police Station, for
the offence punishable under sections 376, 420, 494, 495 r/w. 34
of the Indian Penal Code and accordingly interim protection was
granted to applicant on 27.06.2022.

Heard Learned Advocate Shri V.B.Nehe, for the
applicant and learned A.P.P. Shri Nikam for the State. IO is also
present.

Informant was present and she has objected the
application. Perused the papers of investigation.

It is the case of the prosecution that the applicant
induced the informant pretended that she is his legally wedded
wife and thereby sexually exploited her, when his first marriage
was in existence.

On perusal of record, it reveals that the informant is
major and matured lady. She got acquainted with the applicant
through the Face­book and engaged into relationships.

The
applicant has produced bunch of documents in the form of
complaint lodged against the informant that she is harassing the
applicant and his family members and blackmailing them. Even
the alleged rental flat from which informant claimed to be driven
out is owned by the father of applicant.

On these amongst
grounds, interim bail was granted to the applicant on 27.06.2022.
Now, say is filed by the IO and the formal objections are raised
that medical of the applicant is required to be done.

Considering
the
nature
of
accusation
and
investigation thereof, it is clear that there is no any recovery or
discovery as such from the applicant. Say filed by the IO is also
silent to that effect. As far as medical of the applicant is
concerned, his presence can be secured by imposing condition to
that effect. As per the contention of ld. Advocate, the applicant
has no criminal antecedents. He is a local resident and he is
ready to abide any conditions imposed upon him.

considering all these aspects, this Court is of the view to confirm
the interim protection granted to applicant by imposing certain
conditions. Hence, the order.

::O R D E R::
1]
The application ( Exh. 01) is allowed.

2]
The interim protection granted to applicant
on 27.06.2022 stands confirmed subject to
following conditions.
a] That he shall not tamper with
prosecution evidence in any manner.

the
b] Applicant is directed not to enter the
area/vicinity where the informant resides.
c] Applicant is directed to furnish his
permanent address proof, mobile number on
record.
d] Applicant is directed to mark presenty in
concern police station on every 2nd Sunday
and 4th Sunday of the month in between
10.00 am to 12.00 noon till filing charge­
sheet.

Inform concerned PSO accordingly.
