This is second bail application moved by the applicant accused 1) Vikram Ashok Gaikwad, 2) Sahebrao Lahanu Pawar, 3) Amar Uttam Gaikwad, under section 438 of the Criminal Procedure Code for grant of anticipatory bail in connection with CR No.10/2022 registered with Sinnar Police Station for the offence under section 143,147,148,326,323,504,506,427 r.w.s.149 of the Indian Penal Code (hereinafter referred to as “IPC” for short), in the event of arrest in connection with above referred crime on the same ground set out in the earlier bail application No. 101/2022, which was rejected by this court on 25.1.2022.
2.Heard, both the parties.
3.perused the record. I.O. submitted his report and opposed the bail application.
4.The learned counsel Shri. Avhad submitted that four accused have been arrested by the police. They are now released on bail and only these three accused have not been arrested and therefore, present anticipatory bail application again be considered on the background that other four accused are enlarged on bail, muddemal property is already recovered. They are local resident. They did not jump the bail.
5.This court has considered all these ground in the earlier anticipatory bail application. There is no change in circumstances.
The fact that the four accused have been arrested and enlarged on bail cannot be considered in change of circumstances and therefore, present application is without any merit disposed of. Hence, Therefore, following order is passed.
O R D E R
1) Anticipatory Bail Application No.165/2022 is hereby rejected.
2) Inform the concerned police station accordingly.
