This is an application under Section 438 of Criminal
Procedure Code in Crime No.40/2022 registered at Police
Station, Igatpuri, Dist. Nashik for the offence under Sections 354
& 504 of the Indian Penal Code, 1860. It is the case of
prosecution in brief that the complainant had gone to attend a
relative’s engagement ceremony. During Sangeet, when she was
dancing on the dance­floor, the accused/applicant came there,
held her face by both his hands and asked her to come with him.
When she refused, he pressed her breast.

Ld. Adv. for the applicant has submitted that the FIR
is false.

Custodial interrogation of the applicant is not
necessary. No recovery needs to be made from him. Applicant is
ready to comply with the terms and conditions imposed by the
Court. Therefore, application should be allowed.

Per contra Ld. A.P.P. has opposed the application on
the ground that there is prima­facie case against the applicant
and his custodial interrogation is necessary.

There is prima­facie case against the applicant.

However, considering the fact that nothing needs to be
recovered from him, his custodial interrogation does not appear
to be necessary. In view of the foregoing discussion, I am
inclined to allow the application subject to the following terms
and conditions:
ORDER
1)
The application Exh. 1 is allowed.

2)
In the event of arrest of applicant Vijay Dhondiram
Karnor, he be released on bail by executing P. R. & S. B. of
₹15,000/­with one local surety of like amount.

3)
Applicant shall attend the concerned Police Station on
every Monday and Thursday between 5.00 p.m. to 6.00
p.m. till the filing of the charge­sheet.

4)
Applicant shall co­operate in the investigation and shall
not tamper with the prosecution witnesses.

5)
Applicant shall attend all dates of hearing after filing of
