The applicants/accused Tushar Arjun Pawar claims
bail in C.R. No. I­156/2022 for the offences punishable under
Section 306, 498­A, 504, 506 r/w. 34 of the Indian Penal Code
registered with Wani Police Station.

Heard Learned Advocate Shri S.R.Pagar, for the
applicant, learned A.P.P. Smt. Jadhav for the State. Perused the
papers of investigation.

It is the case of the prosecution that the applicant has
harassed the deceased wife to such an extent that she was left
with no other option but to commit suicide and accordingly,
accused abated the commission of suicide by the deceased.

On perusal of record, it reveals that the incident of
hanging i.e. attempt to commit suicide, occurred on 30.06.2022.
Whereas victim is expired on 06.07.2022.

During the period of her
hospitalization, she did not give any statement against the applicant

and accused.

There is much delay in lodging report, which is not
explained by the informant.

A marriage of the applicant and
deceased was performed in the year 2020. Deceased has one child.
During her life time, there was no any complaint made against the
accused by her or her parents.

There are no specific allegations as to
alleged incident of cruelty. It is submitted by the ld. Advocate for the
applicant that being husband and her in­laws have admitted the
deceased in hospital and have taken all the precaution to provide her
treatment. Report is lodged after due delay of near about 7 days.
Report is hear­say in nature.

Howsoever it may be, record reflects that the applicants
were arrested on 09.07.2022.

Now, there is no any recovery and
discovery as such remains from the applicant.

According to ld.

Advocate for the applicant, the applicant has no criminal antecedents.
He is local resident and is ready to abide any conditions on grant of
bail. Other accused are already released on bail. Therefore, applicant
is also entitled to be released on bail on the ground of parity.
Considering all these aspects, this Court is of the view that applicant
can be released on bail by imposing certain conditions.

Hence the
order.
