There is no F.I.R. But the applicant was called at Police Station by issuing notice to applicant for inquiry on the complaint of informant.

2] Admittedly report is not yet lodged. Learned Advocate for the applicant produced certain documents i.e. notices issued by API to the applicant to remain present for enquiry. In respect of subject matter, applicant has produced copies of registered sale­deed, development agreement, NA order and other relevant documents.

Considering all these documents and the controversy between the parties, apprehension expressed by the applicant cannot be said to be out of place.

3] Learned Advocate for the applicant submitted that the applicant do not have criminal antecedents. He is local resident and is ready to abide any conditions on grant of relief. Hence, considering nature of accusation and investigation thereof following order is passed.

O R D E R
1] Application is partly allowed.

2] Concern I.O. is directed to issue notice to the applicant prior to 72 hours of arrest in case of lodging of F.I.R.

3] Application is disposed of accordingly.
