[Suresh Devidas Mali V/S State]
The applicant­accused Suresh Devidas Mali is facing allegations under Sections 353, 332 and 506 of the Indian Penal Code in connection with the CR No.26/2022 registered with Ghoti Police Station.

It is alleged in the application that applicant­accused that the alleged incident of assault took place on 15.02.2022 at Ghoti at that time there was accident between car and handcart and therefore, huge crowd gathered. At that time, the applicant­accused had abused and voluntarily caused hurt to the first informant and obstructed him while he was discharging his duty as a public servant, therefore, FIR was lodged by the first informant.

I.O. had filed his report on last date vide Exh.6 and opposed the anticipatory bail.

Heard, both parties. APP has opposed the bail.

Perused the record. The offences are non­bailable and triable by this Court. There is no requirement of the custodial interrogation of the applicant­accused, as nothing is to be recovered from the applicant­accused. During the period of an­interim bail applicant­accused has co­operated the I.O. Considering the above said fact and circumstances, following order is passed.

Anticipatory Bail Application No.239/2022 is hereby

Interim anticipatory bail granted by this court to applicantaccused Suresh Devidas Mali by order dated 21.2.2022 is hereby made absolute on same terms and conditions.

Inform concerned Police station.
