The
applicant/accused Suraj Anil @ Pappusokha
Yadav claims bail in C.R. No. I­45/2022 for the offences
punishable under Sections 363, 376 r/w. 34 of the Indian Penal
Code and under Sections 4 & 6 of the POCSO Act registered with
Satpur Police Station.

Heard Learned Advocate Shri A.K.Kale, for the
applicant and learned A.P.P. Smt. Sangale for the State. The
victim alongwith her father is present before the Court. Perused
the papers of investigation.

It is the case of the prosecution that applicant induced
the minor victim, kidnapped her and thereafter forcefully
committed sexual intercourse with her without her valid consent
and made her pregnant.

On perusal of the report, it reveals that initially
missing report was lodged by the father of victim on 02.03.2022.
It is mentioned therein that since 16.02.2022, the victim is
missing from the house of informant.

From the averments in the report itself, it
becomes clear that the victim eloped with the applicant out of
love­affair. They were residing together for about 3 to 4 months
but there are not allegations as to any violent act committed by
the applicant against the minor victim.

The ld. Advocate for the applicant submitted that it is
the case of love­affair.

Applicant is only 21 years old.

victim is 17 years old and at the verge of majority.

Now, there is no recovery
or discovery as such remains from the applicant.

According to
ld. Advocate for the applicant, applicant has no criminal
antecedents.

He is ready to abide any conditions on grant of
bail. Considering all these aspects, this Court is of the view that
applicant can be released on bail by imposing certain conditions.
Hence the order.

Application is hereby allowed.

In the event of arrest of the applicant – Amol
Avinash Chavan in C.R. No. 16/2022 of Wani Police
Station, be released on
PR and SB of Rs.20,000/­
with one or two solvent sureties in the like amount
subject to following conditions.

a)
Not to act in manner injurious to the interest of
the prosecution.

b)
maintain law and order.

c)
furnish the address of his residence, copy of Pan
or the Adhar card at the time of execution of bond
and shall not change the residence without prior
permission of this Court.

d)
He shall attend the concerned police station as
and when called by the Investigating Officer and
cooperate with the investigation.
