{ Sumit @ Sonu Ravindra Khatikade Vs. State }

This is application under section 439 of the Criminal Procedure Code for grant of bail pending trial.

2.The present application is moved by the applicantaccused Sumit @ Sonu Ravindra Khatikade praying to release him on bail in connection with the CR No.862/2021 registered with Trimbakeshwar Police Station under section 307, 326, 324, 323, 504, 506, 427 r.w.s.34 of the Indian Penal Code and section 4/25 of the Arms Act.

3.Applicant has moved present bail application stating that it is first bail application. Charge­sheet is filed in the court. He is ready to abide all conditions laid down by this court and prayed to allow the bail application.

4.The State has opposed the bail application stating that accused is played main role in commission of the crime. Offence is serious and therefore, accused may not be released on bail.

5.Perused record. Heard both the parties.

6.The learned advocate Shri. Avhad has submitted that accused has filed first bail application since his arrest and chargesheet is filed and investigation is completed in all respect. Accused is to be committed to this court. Accused in jail since his arrest i.e. from 17.10.2021 more than three months have been lapsed. Injured is discharged from the hospital.

7.I.O. has submitted that injured is discharged from the hospital.

8.This Court has enlarged one of the accused Ganesh Dnyaneshwar Monde in Bail Appln. No.1768/2021 on 11.1.2022. Considering the fact that police have filed charge­sheet in the court, injured is stable and discharged from the hospital, no purpose would be served by keeping the accused behind bar, as it will take to commit the charge­sheet in this court and to initiate the trial, necessary conditions can be imposed. Hence, following order is passed.

O R D E R

1.Application is allowed.

2.Applicant­accused Sumit @ Sonu Ravindra Khatikade in connection with the CR No.862/2021 registered with Trimbakeshwar Police Station under section 307,326,324, 323, 504, 506, 427 r.w.s.34 of the Indian Penal Code and section 4/25 of the Arms Act, be released on bail on executing bond of Rs.50,000/­ with solvent surety in like amount.

3.He shall not abscond or tamper with the witnesses.

4. He shall furnish their address proof aadhar card of his two near relatives alongwith mobile numbers.

5.He shall attend the court on every date and co­operate during trial.

6.In the event of breach of any of the conditions, his bail bonds shall be liable to be cancelled.

7.Bail in lower Court.
