This bail application is moved by the applicant­accused Suman Shrihari Shelke under section 439 of the Criminal Procedure Code for grant of bail in connection with CR No. 112/2022 registered with Nashik Taluka Police Station, Dist. Nashik for the offence under section 302, 323, 341,352 r/w sec. 34 of the Indian Penal Code on 16.6.2022 in respect of alleged incident of murder of Balwant Kondaji Shelke.

2.On perusal of the record and written argument filed by the applicant­accused Charge­sheet is committed to the Court of Session vide Session Case No.429/2022. On verification of CIS, it appears that Session Case No.429/2022 is allotted to the District Judge­1, Nashik and pending on the file of this Court. Therefore, considering these facts and situation, it would not be proper to decide this bail application particularly when the matter is pending in another Court. It would be proper that the applicant­accused should approach to the District Judge­1, Nashik for seeking relief of bail. Hence, present bail application is disposed off with liberty to file fresh application before District Judge­1, Nashik.
