This application has been filed by the applicants/accused
under section 438 of Cr.P.C. for releasing them on anticipatory bail
in the event of their arrest in the aforesaid Crime registered at
Bhadrakali Police Station, for the offence punishable under section
498­A, 406, 354, 323, 504 & 506 r/w. 34 of the Indian Penal Code and
accordingly interim protection was granted to applicants.

Heard Mr. B.G.Gore learned Advocate for applicants and
learned APP Smt. Sangale.

Perused the say filed by IO and also
perused the papers.

It is the case of the prosecution that the applicants being
husband and in­laws of the informant, have illtreated and harassed
her for unlawful demand and treated her with cruelty and accused
No.4 outraged the modesty of informant.

On perusal of record, it reveals that marriage of the
informant was solemnized in the year 2019.

There are general
allegations in the complaint as to harassment and unlawful demand.
It reveals from the application that the informant has filed litigation
under D.V.Act and also filed application for divorce.

Prima facie
dispute appears to be marital in nature. Thus, there is vast delay in

lodging the report and same is not explained by the informant. Prima
facie, it appears that there is matrimonial dispute between the
parties. On these amongst ground, interim bail was granted to
applicants on 12.08.2022.

Now, say is filed by the IO and the formal
objections are raised. It appears that applicants have cooperated the
investigation.

As per the contention of ld. Advocate for the applicants,
the applicants have no criminal antecedents. They are ready to abide
any conditions imposed upon them. Therefore, considering all these
aspects, this Court is of the view to confirm the interim protection
granted to applicants. Hence, the order.
