applicant/accused Salman Ahmad Rizwan
Ahmad Sayyed claims bail in C.R. No. I­116/2022 for the
offences punishable under Section 376(2)(n) of the Indian Penal
Code registered with Sinnar Police Station.

Heard Learned Advocate Shri S.R.Inamdar, for the
applicant and learned A.P.P. Smt. Sangale for the State. Perused
the papers of investigation.

It is the case of the prosecution that applicant has
induced informant on false promise of marriage and sexually
exploited her and made her pregnant.

On perusal of record, it reveals that there are specific
allegations against the applicant that he proposed informant for
the marriage to which she consented.

He insisted for physical
relationships pretending that he would certainly marry her.
Applicant had been to the house of informant and told the family
members of informant that he is owing to marry the informant.
But when informant became pregnant, applicant refused to
marry.

It is the contention of informant that when she went to
the house of applicant, she came to know that he is married.
Thus, prima facie case against the applicant, is established.

Informant is the major lady of 19 years old. She was
in relationship with the applicant for about one year. Though,
prima facie case is established against the applicant, it would be
the subject matter of trial.

At this stage, it is to be taken into
consideration that applicant came to be arrested on 27.03.2022.
Now, investigation is complete. There
is
no
discovery as such pending from the applicant.

Advocate for the applicant, applicant has no criminal antecedent.
He is local resident and he is ready to abide any conditions
imposed by this Court. Considering all these aspects, this Court
is of the view that applicant can be released on bail by imposing
certain conditions. Hence, the order.

Applicant­Accused Salman Ahmad Rizwan
Ahmad Sayyed arrested in C.R. No. I­
116/2022 for the offences punishable under
Section 376(2)(n) of the I.P.C. registered with
Sinnar Police Station, be released on bail in
the sum of Rs.25,000/­(Rupees Twenty­five
Thousand only) with one or two sureties in
the like amount subject to following
conditions :­
a] That he shall not tamper with
prosecution evidence in any manner.

b] Applicant is directed not to enter the
area/vicinity where the victim resides till end
of trial.
c] Applicant is directed to furnish his
permanent address proof, mobile number and
copies of medical treatment papers on record.
