The applicants/accused Sainath Bhimraj Wakale
claims bail in C.R. No. I136/2022 for the offences punishable
under Sections 304B, 498A, 323, 504, 506 of the Indian Penal
Code registered with Vavi Police Station.

Heard Learned Advocate Shri V.B.Golesar, for the
applicant, learned A.P.P. Smt. Sangale for the State. Perused the
papers of investigation.

It is the case of the prosecution that applicant being
husband of the deceased illtreated her with cruelty and thereby
abetted and instigated the commission of alleged suicide by her.
There are also allegations that on the day of incident, accused

applicant accompanied the deceased. They were proceeding from
the maternal house of deceased at Ghulewadi, Sangamner, Dist.
Ahmadnagar to their village. During the journey, allegedly they
stopped near Wavi village where deceased jumped into the well
and committed suicide.

On perusal of record, it reveals that there are specific
allegations against the applicant that he was harassing the
deceased for unlawful demand of money.
Soon before the
incident, deceased asked informant/her father that accused is
harassing her much. Therefore, she requested him to take her to
his house.
Accordingly, he has taken her to his house.
On
15.07.2022, accusedapplicant came to his house and resided
there for two days. At that time also, informant consoled him to
cohabit properly and not to harass the deceased.
Then, on
17.07.2022, applicant took the deceased and their daughter on
motorcycle and proceeded towards their village.

At about 12.45 pm, accused made
phonecall to informant and told him that deceased fell down in
the well.
Such incident at the first glance itself appears to be
very much doubtful.
Prima facie concern of the applicant with
alleged offence is thus becomes clear.

Offence allegedly committed by the applicant is very
much serious in nature.
Averments in the report reflects
consistent harassment at the hands of accusedapplicant to the

deceased. Now, chargesheet is filed in the Court.
There are
statements of witnesses as to alleged harassment to the
deceased.
If the applicant would be released on bail, there is
every possibility that he may pressurize the witnesses and
tamper with prosecution evidence.
Therefore, considering all
these aspects, this Court is of the view that, applicant is not
entitled to be released on bail.
Hence the order.

Application (Exh.1) stands rejected.
