The applicants/accused Sahebrao Premrao Jadhav
claims bail in C.R. No. I271/2022 for the offences punishable
under Sections 306, 498A r/w. 34 of the Indian Penal Code
registered with Ambad Police Station.

Heard Learned Advocate Shri R.S.Nagare, for the
applicant, learned A.P.P. Smt. Aparna Patil for the State and
Adv. Shri Shejwal for intervenor. Perused the papers of
investigation.

It is the case of the prosecution that applicant being
brotherinlaw of the deceased illtreated and harassed her and
thereby abetted the commission of suicide by the deceased.

On perusal of record, it reveals that the incident
occurred on 10.06.2022 i.e. suicide committed by Ashwini. There
are allegations against the applicant and other accused that they
used to suspect the character of deceased Ashwini and illtreat
her for unlawful demand.
Prima facie involvement of the
applicant with alleged offence is thus becomes clear. But then, it
is to be taken into consideration that the applicant came to be
arrested on 11.06.2022. Now, investigation is complete and
thereby chargesheet is filed. Physical custody of the applicant is
thus no more required for investigation. One of the accused is
already released on bail. Therefore, on the ground of parity also,
applicant is entitled for the relief claimed. According to learned
Advocate, the applicant has no criminal antecedents. He is a local
resident and he is ready to abide any condition on grant of bail.
Considering all these aspect, this Court is of the view that
applicant can be released on bail by imposing certain stringent
conditions. Hence, the order.

the sum of Rs.15,000/(Rupees Fifteen
Thousand only) with one or two sureties in
the like amount subject to following
conditions :
a] That she shall not tamper with
prosecution evidence in any manner.

b] Applicant is directed not to contact any
witness and interfere with the investigation
in any manner.
c] Applicant is directed to furnish her
permanent address proof, mobile number and
copies of medical treatment papers on record.
