The
applicant/accused Sachin Jalinder Pund
claims bail in C.R. No. I­82/2021 for the offences punishable
under Sections 363, 376 of the Indian Penal Code and under
Sections 4 & 8 of the POCSO Act and 3(1)(w)(i)(ii), 3(2)(va), 3(2)
(v) of the Scheduled Caste & Scheduled Tribes (Prevention of
Atrocities) Act registered with Adgaon Police Station.

Heard Learned Advocate Shri A.K.Kale, for the
applicant and learned A.P.P. Smt. Sangale for the State. Victim
is present before the Court. Perused the papers of investigation.

It is the case of the prosecution that applicant induced
minor victim, kidnapped her and thereby kept sexual relations
with her without her valid consent.

On perusal of report, it reveals that the report is
lodged by the father of minor victim on 10.06.2021 that the
victim left her house on her own pretending that she is going for
washroom at 09.00 pm. Therefore, missing report was lodged on
10.06.2021.

During investigation, victim was found in the
company of applicant.

Today, victim is present in the Court.

She has stated that she has no complaint against the applicant.
Ld. Advocate for the applicant submitted that victim eloped with
the applicant out of love­affair. Record reflects that applicant
has not acted violently against the victim.

The present applicant is a young boy of 25 years old.

He came to be arrested on 18.06.2022.

There is no any recovery
or discovery as such remained from the applicant.

According
to ld. Advocate for the applicant, the applicant has no criminal
antecedents.

He is a local resident and is ready to abide any
conditions on grant of bail.

Considering all these aspects, this
Court is of the view that applicant can be released on bail by
imposing certain conditions. Hence the order.

Applicant­Accused Sachin Jalinder Pund
arrested in C.R. No. I­82/2021 for the
offences punishable under Section 363, 376 of
the I.P.C. and under Sections 4 & 8 of the
POCSO Act and under section 3(1)(w)(i)(ii),
3(2)(va), 3(2)(v) of the SC & ST Act
registered with Adgaon Police Station, be
released on bail in the sum of Rs.15,000/­
(Rupees Fifteen Thousand only) with a
surety in the like amount subject to following
conditions :­
a] That he shall not tamper with
prosecution evidence in any manner.

b] Applicant is directed not to enter the
area/vicinity where the victim resides till end
of trial.
