Order below Exh.1 in Cri. Bail Application No.424 /2022
(Sachin Chunilal Dhangarapplicant/accused1 Vs. State ) This is an application, for bail u/s. 439 of Cr.P.Code in C.R. No.82 of 2022 registered with Panchavati Police Station, Nashik u/ss. 394,177, 201 r/w.34 of The Indian Penal Code(IPC).
2.The learned counsel Mr.A.S.Deshmane for the applicant submits that, applicant/accused is innocent person and he has been falsely implicated. He is ready to abide by any of the terms and conditions to be imposed by this Court. He is only earning member of his family. He was arrested on 05.03.2022. He has got fixed and permanent place of residence and undertakes to cooperate investigation.
3.Learned A.P.P. Mr. R.M. Baghdane, by filing pursis (Exh.4) adopted say (Exh.3) filed by Investigation officer (I.O.) and strongly objected this application. I.O. present.
4.Perused record. It is case of prosecution that at about 3.15 p.m., in the marriage office, while informant was breast feeding, 2 unknown persons entered there, one of them pointed Gun to her and told to handover the gold ornaments of her neck.
When she refused, he forcibly snatched it. While she tried to catch the same, part of it came to her hand and its part was taken away.
After hue and cry, people came there for rescue and the person who pointed out Gun on her was caught hold by crowed and handed over to the police who is accused 1. Latter on, it was found
that, is was ToyGun.Thus, the present accused has been caught red handed. Initially, he disclosed his wrong name as Sandip Laxman Patil but thereafter he revealed his name. He has previous criminal antecedents, as various C.R. are pending against him in various police stations. Offence is serious one. There is direct involvement of the accused. There is every likelihood that he may abscond and hamper or tamper prosecution witnesses and evidence. Considering his role, law of parity is also not applicable to the present applicant. Grounds shown in this application are not just and satisfactory to release him bail. In the circumstances, I am not inclined to exercise my discretion in favour of the applicant.
Consequently, this application is liable to be rejected. Hence, the following order.
ORDER
This application stands rejected.
