NO. 961 OF 2022
{Sachin Ashok Pawar vs. The State of Maharashtra through Ambad
Police Station}
This is the bail application under section 439 of the
Criminal Procedure Code, 1973 filed by the applicant-accused in crime
No. 305 of 2022 registered with Ambad Police Station for the offence
punishable under section 302 of the I. P. C.

The applicant contended that false and fabricated case is
registered against him. He is innocent and falsely involved in the crime.
He is permanent resident mentioned in the application. He has no
criminal antecedent. He has one daughter and she is dependent on him.
He is ready to cooperate the I. O. In the police papers shows that the
deceased eloped and stayed with Santosh @ Sanjay Bhalchandra
Ranyeole for few months back and returned back in the company of the
accused. She had conversion with him on his mobile phone. He has
informed the Walunj MIDC, Aurangabad police about the incident. He is
ready to abide any conditions imposed by the Court. Hence, he has
prayed for grant of bail.

learned APP has filed say at Ex. 04 and I. O. has also filed
say at Ex. 05. They have stated that the offence is of serious nature. The
accused killed his wife in the room in which they were staying, on the
count of her illicit relation with Santosh @ Sanjay Bhalchandra
Ranyeole. He killed his wife by knife. The knife is seized from him. The
knife was used in the crime is the opinion of the M. O. The accused
himself went away in the bus to Aurangabad and reported the murder of
his wife there. There is strong evidence against him. If he is released on
bail, he will threat the prosecution witnesses. Hence, they have prayed
for rejection of bail.

Heard the learned counsel for the accused and learned APP.

They have argued as per their stand taken.

I have gone through application, say, arguments,
documents and police papers. There is strong prima-facie case against
the accused. The accused and the deceased were residing in the said
room. Immediately, after her murder, he has not informed it to the
nearest police station and went to Aurangabad and informed at
Walunj MIDC Police Station. His conduct appears to be unnatural.
Blood stained clothes were seized from his person. The weapon is also
seized from him. The deceased died in the custody of his husband.
He locked the door of that room out side. There is strong evidence of
motive to kill her as she had an affair with another man. Considering
the nature of the evidence, gravity of offence to be very serious and
punishment is severe, he is not entitled for bail. Hence, the following
order:
