The
applicants/accused Rahul Eknath Jakhere and
Eknath Radhakrishna Jakhere claim bail in C.R. No. I­62/2022
for the offences punishable under Sections 306, 498­A, 323, 504,
506
r/w. 34 of the Indian Penal Code registered with Ghoti
Police Station.

Heard Learned Advocate Shri Y.D.Lakariya, for the
applicant and learned A.P.P. Smt. Sangale for the State. Perused
the papers of investigation.

It is the case of the prosecution that applicant No.1
being the husband of the deceased and applicant No.2 being
father­in­law of the deceased have illtreated her and abated the
commission of suicide by the deceased Mohini.

On perusal of record, it reveals that Mohini got
married with applicant No.1 on 27.02.2022.

On 01.05.2022,
applicant had been to the house of informant to ask whereabouts
of Mohini.

He informed that Mohini left the house in the
morning.

Applicant No.1 has also lodged missing report about
the incident.

Thereafter, on 08.05.2022, dead­body of deceased
Mohini was found in the water stream of Darna Dam. There are
allegations against the applicant that they have illtreated the
deceased and abated the commission of suicide by her but there
is no specifications to that effect.

Other accused were released on bail.

The
investigation is complete and thereby charge­sheet has been
filed.

There is no recovery or discovery as such remains from
the applicant. According to ld. Advocate for the applicants, they
have no criminal antecedents.

They are local resident and are
ready to abide any conditions on grant of bail.

Considering all
these aspects, this Court is of the view that applicants can be
released on bail by imposing certain conditions.

offences punishable under Section 306, 498­

registered with Ghoti Police Station, be
released on bail in the sum of Rs.15,000/­
(Rupees Fifteen Thousand only) each with a
surety in the like amount subject to following
conditions :­
a] That they shall not tamper with
prosecution evidence in any manner.

from their appearance by an express order of
Court.

Application is hereby allowed.

In the event of arrest of the applicant – Amol
Avinash Chavan in C.R. No. 16/2022 of Wani Police
Station, be released on
PR and SB of Rs.20,000/­
with one or two solvent sureties in the like amount
subject to following conditions.

a)
Not to act in manner injurious to the interest of
the prosecution.

b)
maintain law and order.

c)
furnish the address of his residence, copy of Pan
or the Adhar card at the time of execution of bond
and shall not change the residence without prior
permission of this Court.

d)
He shall attend the concerned police station as
and when called by the Investigating Officer and
cooperate with the investigation.
