The applicant/accused Rahul Bajirao Pawar claims
bail in C.R. No. I­206/2022 for the offences punishable under
Sections 363­A, 376(2)(j), 376(2)(n) r/w. 34 of the Indian Penal
Code and under Sections 4, 8 & 12 of the POCSO Act registered
with Sinnar Police Station.

Heard Learned Advocate Shri G.L.Bodake, for the
applicant and learned A.P.P. Smt. Sangale for the State. Perused
the papers of investigation.

It is the case of the prosecution that applicant induced
the minor victim, kidnapped her and thereafter forcefully
committed sexual intercourse with her.

Notice was served upon the informant/victim. She was
present in the Court.

She has stated before Court that she do
not want to proceed with the case.

cheated her. Howsoever it may, averments in the report reflects
that the applicant and the informant were acquainted with each
other. Report reflects that the informant on her own went with
the applicant.

One other accused was also with them.

The ld. Advocate for the applicant submitted that it is
the case of love­affair. Applicant is only 22 years old. There is
no age proof of the victim on record. She allegedly 14 years and
six months old.

There are no allegations as to violent act has
been committed by the applicant against the victim.

Applicant came to be arrested on 20.05.2022.

Considering all these aspects, this
Court is of the view that applicant can be released on bail by
imposing certain conditions. Hence the order.

Application is hereby allowed.

In the event of arrest of the applicant – Amol
Avinash Chavan in C.R. No. 16/2022 of Wani Police
Station, be released on
PR and SB of Rs.20,000/­
with one or two solvent sureties in the like amount
subject to following conditions.

a)
Not to act in manner injurious to the interest of
the prosecution.

b)
maintain law and order.

c)
furnish the address of his residence, copy of Pan
or the Adhar card at the time of execution of bond
and shall not change the residence without prior
permission of this Court.

d)
He shall attend the concerned police station as
and when called by the Investigating Officer and
cooperate with the investigation.
