ORDER BELOW EXH. No.1 (Delivered on 04 th March, 2022)
1.Read the application and the say filed by the respondent vide Exh.6. Herard Ld. Advocate for the applicant and Ld. A.P.P. for the State.
2.Crime stood registered bearing No. C.R. No.I23 of 2021 at Cyber Police Station, Nashik on 07.06.2021 under 67 (b) of I.T. Act. It is alleged in the F.I.R. that the applicant had uploaded child phonography on social media account on 19.05.2020 in the evening.
3.It is the case of the applicant that he is an innocent and falsely implicated in this case. His account was hacked and he had made a request to his friend to follow his new ID. The applicant is ready to abide by the terms and conditions. Therefore, prayed to allow the application.
4.Respondent objected on the ground of serious of the offence.
5.Upon hearing and going through the material placed on record, what can be gathered from the say filed by the respondent is that the custodial interrogation of this applicant is not necessary to the Police. Therefore, by imposing certain conditions this Court finds that the application can be allowed. Hence, the order.
O R D E R
1.Criminal Bail Application No.193 of 2022 is allowed.
2.In the event of arrest, Applicant Pushkar Bharat Jadhav be released on bail on his executing a personal bond of Rs.15,000/each with solvent surety in like amount to the satisfaction of the I.O.
3.Applicant to remain present before the I.O. as and when he calls under prior written intimation and cooperate the I.O. in the investigation.
4.Applicant not to commit similar offence in future.
5.In the above terms, the Criminal Bail Application No.193 of 2022 stands disposed off accordingly.
