The applicant/accused Pravin Navnath Gunjal @
Kalya claims bail in C.R. No. I­206/2022 for the offences
punishable under Sections 363­A, 376(2)(j), 376(2)(n) r/w. 34 of
the Indian Penal Code and under Sections 4, 8 & 12 of the
POCSO Act registered with Sinnar Police Station.

Heard Learned Advocate Shri B.G.Gore, for the
applicant and learned A.P.P. Smt. Sangale for the State. Perused
the papers of investigation.

It is the case of the prosecution that applicant has
facilitated the offence of kidnapping and rape upon the victim by
the other accused.

On perusal of report, it reveals that there are only
allegations against the applicant that he has brought motor­cycle
and carried the victim and accused No.1 at some place, from

where the victim and accused No. 1 went on their own. As such,
there are no direct allegations as to the participation of applicant
in the alleged crime and about knowledge of the same.

The present applicant is a young boy of 22 years old.

He came to be arrested on 20.05.2022. Now, the investigation is
near about complete.

There is no any recovery or discovery as
such is pending against the applicant.

According to ld.

Advocate for the applicant, he has no criminal antecedents.

He
is a local resident and is ready to abide any conditions on grant
of bail.

Considering all these aspects, this Court is of the view
that applicant can be released on bail by imposing certain
conditions. Hence the order.

the offences punishable under Section 363­A,

released on bail in the sum of Rs.15,000/­
(Rupees Fifteen Thousand only) with a
surety in the like amount subject to following
