ORDER BELOW EX. 01 IN CRIMINAL BAIL APPLICATION
NO. 830 OF 2022
{Pravin Manohar Joshi and another vs. The State of Maharashtra
through Satpur Police Station}
This is the bail application under section 439 of the
Criminal Procedure Code, 1973 filed by the applicants-accused in crime
No. 162 of 2022 registered with Satpur Police Station for the offences
punishable under section 7 read with 13(1) and 13(2) of the Prevention
of Corruption Act.

The applicant contended that false and fabricated case is
registered against them. Investigation is almost completed and nothing
remain to be recovered from them. They have deep roots in the society.
They are ready to abide by any conditions imposed by the court. They
have prayed for grant of bail.

learned APP has filed say at Ex. 05 and I. O. has also filed
say at Ex. 06. They have stated that the offence is of serious nature. Yet,
the voice sample of the accuse dis to be taken and panchnama is to be
prepared. Further investigation is to be done to know from whom they
further demanded bribe amount. The evidence of witnesses are yet to be
recorded. Hence, they have prayed for rejection of bail.

Heard the learned counsel for accused and learned APP.

They have argued as per their stand taken.

I
have
gone
through
application,
say,
arguments,
documents, police papers. There is prima-facie case against both the
accused. But, considering the facts that the offence is not punishment
with more than seven years of imprisonment and the investigation is
almost completed and nothing remained to be recovered from the
accused. Also, the voice sample of the accused is taken and the
panchnama is prepared. Accused have no criminal antecedent and
keeping them behind bar will not serve any purpose. On suitable terms

and conditions, they can be released on bail. Hence, the following
order:

Application is allowed.

Accused namely Pravin Manohar Joshi and Kushal
Magannath Aucharmal released on bail on
executing personal bond of Rs. 15,000/- with one
or more surety in the likewise amount each in
crime No. 162 of 2022 registered with Satpur
Police Station for the offences punishable under
section 7 read with 13(1) and 13(2) of the
Prevention of Corruption Act.

The accused shall attend police station on
05.07.2022 and 06.07.2022 in between 11.00 a.m.
to 02.00 p.m. and also shall also attend the police
station as and when their attendance is required by
the I. O.

They shall not directly or indirectly make any
inducement, threat or promise to any person
acquainted with the facts of the case so as to
dissuade them from disclosing such facts to the
court or to any police officer to tamper with the
evidence.

They shall not tamper the prosecution evidence in
any manner.

06]
They shall not leave India without permission of
this court.

07]
They shall not commit similar type of offence.

08]
They shall furnish their detailed address with proof
and their mobile numbers.
