The present application is moved by the applicant
accused Prashant Gautam Jadhav under section 438 of Cr.P.C. in
connection with CR No. 105/2022 registered with Nashik Taluka
Police Station, Dist. Nashik for the offence U/s. 379, 447, 506 of the
Indian Penal Code on 7.6.2022.

It is stated in the application that there is dispute
between the parties in respect of the land Gat No.8/2/2
admeasuring 00 H 87.42 R situated at mauje Govardhan, Tal.
Nashik and out of the said litigation a crime was registered by the
police against the present applicantaccused and therefore,
applicantaccused has apprehension of arrest in connection of the
said crime.

I.O. is present and filed his report and opposed the bail
application.

On perusal of the record, it appears that there is civil
dispute between the parties. The other two accused are released on
bail by the trial Court on 8.6.2022. The applicantaccused is
practicing
advocate.
Considering
the
above
said
fact
and
circumstances, there is no need of custodial interrogation of
applicantaccused with police as it is documentary evidence and on
the background of this, I am inclined to allow the present
anticipatory bail application with certain conditions. Hence,
following order.

1)
Anticipatory
allowed.
2)
Interim anticipatory bail granted by this court to applicant
accused Prashant Gautam Jadhav by order dated 9.6.2022
is hereby made absolute on same terms and conditions.
3)
Applicantaccused shall cooperate with the I.O. and
produce the documents which are called by him.
4)
Applicantaccused shall attend the police station as and
when called by the I.O. and shall not tamper the
prosecution evidence, in any manner.
5)
Inform to concern police station accordingly.
