This
application
has
been
filed
by
the
applicant/accused under section 438 of Cr.P.C. for releasing him
on anticipatory bail in the event of his arrest in the aforesaid
Crime registered at Upnagar Police Station, for the offence
punishable under sections 376, 354, 504, 506 r/w. 34 of the
Indian Penal Code.

Heard Learned Advocate Shri Vaishampayan, for the
applicant and learned A.P.P. Smt. Sangale for the State.
Perused the papers of investigation and objection filed by the
informant.

It is the case of the prosecution that the applicant has
induced the informant on false promises.

He has grabbed

substantial amount from the informant under one or other
pretext.

He has sexually ravished Victim in the year 2012.

Then, he was blackmailing her.

On perusal of record, it reveals that the allegations in
the report are since 2010.

Informant is a major and matured
lady. It is her contention that she has given various amounts to
the applicant.

On the contrary, it is the contention of applicant
that there was business transaction between applicant and
brother of informant.

Account is settled.

He has produced
documents to that effect i.e. receipts issued by informant,
partnership deed and bank receipts for deposit of money. Prima
facie documents on record reflects that there was business
transaction between the applicant and informant party, both are
relatives of each other.

Allegations in respect of rape are of the
alleged incident in the year 2012.

Now,
charge­sheet is already filed and thereby investigation is
complete. Other accused are already released on bail.

The ld. Advocate for applicant
submitted that applicant has no criminal antecedents. He is local
residents. He is ready to abide any condition on grant of bail.
Therefore, anticipatory bail can be granted to the applicant.

only) with one or two sureties in the like
amount subject to following conditions :­
a] That he shall not tamper with
prosecution evidence in any manner.

of trial.
c] Applicant is directed to furnish his
