1. The applicant/accused Pawan Vasant Bhalerao claims bail in C.R. No. I 108/2022 for the offences punishable under Sections 306, 323, 504, 506 read with 34 of the Indian Penal Code registered with Dindori Police Station, Nashik.
2.Heard Learned Advocate Smt. U. V. Mundada, for the applicant and learned A.P.P. Shri Kotwal for the State. Perused the papers of investigation.
3.It is the case of the prosecution that the applicant being husband of the deceased harassed her, and treated her with cruelty to such an extent that she was left with no other option but to commit suicide and thereby accused abetted the commission of suicide by his wife Manisha.
4.On perusal of record, it reveals that marriage of applicant and deceased was performed in the year 2011. There are allegations that accused used to illtreat and harassed the deceased. They used to beat up her brutally. Police complaint was also made to that effect. There is specific mention about the incident dated 11.08.2022 that accused assaulted her and thereby there were marks of assault on her back. Thereafter on 13.08.2022 Manisha returned to her matrimonial house. On that day informant made phone call to the applicant but he did not allow him to talk with Manisha. On 01.09.2022 Manisha committed suicide by jumping before running train.
5.Thus there are specific allegations in the report as to act committed by applicant and other accused. Proximate link to connect the incident is prima facie reflects from the averments in the report. Offence allegedly committed by the applicant is serious in nature. Thorough investigation is required to be done.
If the applicant would be released on bail, there is every possibility that the applicant may pressurize the prosecution witnesses and tamper with prosecution evidence. Therefore, this Court is of the considered view that the applicant is not entitled for grant of bail. Hence the order.
