This is an application under section 438 of the Code of
Criminal Procedure since the applicants apprehend arrest in an
offence under Section 498­A of the I.P.C. which may get registered
against them at Ambad Police Station, Nashik by the complainant
Pallavi Omkar Harane.

Learned Advocate for the applicants has submitted that
the above complainant has served them a legal notice setting out
allegations as well as settlement terms.

Applicants therefore
apprehend that a complaint under Sec., 498A of the I.P.C. may get
registered against them at Ambad Police Station, Nashik. Applicants
are ready to abide by the terms and conditions imposed by the Court
and also co­operate with the investigating agency. Custodial
interrogation of the applicants is not necessary.

FIR is not yet registered. Offence appears to be primarily
under Sec. 498­A of the I.P.C. In view thereof, I am inclined to allow
the application in terms of the following order.

Ambad Police Station, Nashik is directed to give 72
hours prior notice to arrest the applicants
Omkar Anil Harane, Santoshi Anil Harane, Anil
Vithoba Harane, Apurva Anil Harane, Yogita Sanjay
Desai, Sanjay Ananda Desai, Vaibhavi Sanjay Desai,
Deepak Ganapati Shinde in case an offence against
them is registered at the instance of the complainant
Pallavi Omkar Harane under Section 498A of the I.P.C.
