Read the application and the say filed vide Exh.6. Heard Ld.
Advocate for the applicant and Ld. A.P.P. for the State.

Crime stood registered bearing No.I121/2022 against the
applicant and Juvenile Conflict of Law under Sections 307, 326 and 504
r/w 34 of the Indian Penal Code at the Respondent/ Ambad Police Station
for an allegation that, for some unknown reason, applicant and Juvenile in
Conflict with Law assaulted the son of complainant Varun Mokal by iron
rod on his head and abused him.

It is the case of the applicant that, he is permanent resident of
the address mentioned in the title clause and he is falsely implicated.
Incident is of 17.03.2022. He came to be arrested on 18.03.2022 and since
then he is in custody. Nothing is to be recovered or discovered at his
instance. Investigation is on the verge of completion. Ready to abide by the
terms and conditions. Therefore, prayed to allow the application.

Respondent objected on the ground of seriousness of the
offence. The applicant may threaten and pressurize the victim as they are
residing in the same vicinity. Therefore, prayed to reject the application.

Both the Ld. Advocates argued in tune with their contentions.

Upon hearing and going through the material placed on
record, this Court finds that, the incident is of 17.03.2022 and the accused
came to be arrested on 18.03.2022 since then he is in custody. Juvenile in
Conflict with Law came to be taken in custody and was produced before the
Juvenile Justice Board (J.J.B.) and it is submitted that, he was enlarged on
bail. Ironrod is recovered. Victim is discharge from the Hospital.
Investigation is almost completed. No purpose will be served in keeping the
applicant behind the bar. By imposing certain conditions, the application
can be allowed. Hence, the order.
ORDER
1.
Criminal Bail Application No.517 of 2022 is allowed.
2.
Applicant Nilesh Sunil Kumawat be released on bail on his
executing a personal bond of Rs.25,000/ with one or more solvent
sureties in like amount to the satisfaction of the concerned Ld.
J.M.F.C. in connection with C. R. No.I121/2022 registered with the
respondent Ambad Police Station for an offence punishable under
Sections 307, 326 and 504 r/w 34 of the Indian Penal Code.

Applicant not to threaten and pressurize the complainant, victim and
the witnesses.
4.
Applicant not to commit similar offence in future.
5.
In the above terms, the application stands dispose off accordingly.
