Heard Ld. Advocate Mr. R.D.Tidke for the applicant. There is no F.I.R. But the applicant was called at Police Station by making phone­call to his brother for inquiry on the complaint of informant. As such there is reasonable apprehension of arrest to the applicant.

2] Admittedly report is not yet lodged. There are specific averments in the application that police officials named as Kokate is making phone­call to the brother of applicant and asked the applicant to be present for inquiry in police station. Thus, considering the phone­call by the Police to the applicant and background facts of the dispute between the parties, it appears that there is reasonable apprehension to the applicant of arrest in cognizable offences.

Applicant do not have criminal antecedents. Hence, considering nature of accusation and investigation thereof following order is passed.

O R D E R

1] Concern I.O. is directed to issue notice to the applicant prior to 72 hours of arrest in case of lodging of F.I.R.

2] Application is disposed of accordingly.
