The
applicant/accused Milind Prakash Dahite
claims bail in C.R. No. I­122/2022 for the offences punishable
under Sections 306, 304­B, 498­A, 504 r/w. 34 of the Indian Penal
Code registered with Satpur Police Station.

Heard Learned Advocate Shri R.D.Avhad, for the
applicant and learned A.P.P. Smt. Jadhav for the State. IO is
also present. Perused the papers of investigation.

It is the case of the prosecution that the applicant has
harassed the deceased for unlawful demand to such an extent
that she was left with no other option but to commit suicide and
accordingly, accused­applicant abated the commission of suicide
by the deceased.

On perusal of record, it reveals that this is the
successive bail application filed by the applicant on the ground
that the investigation is complete and that there is no recovery
or discovery as such remains from the applicant. Charge­sheet is
also filed by the investigating officer. Previous bail application
was rejected on merit considering prima facie concern of the
applicant with alleged offence. But then, as submitted by the ld.
Advocate for the applicant, the investigation is now complete.
Physical custody of the applicant is no more required for
investigation.

According to ld. Advocate for the applicant, the
applicant has no criminal antecedents. He is a local resident and
is ready to abide any conditions on grant of bail. Considering all
these aspects, this Court is of the view that applicant can be
released on bail by imposing certain conditions. Hence the order.
