Read the application and an affidavit filed in its support.
Perused the documents filed alongwith Exh.3. Heard Ld. Advocate for
applicants.

Ld. Advocate for applicants submits that there was a financial
transaction to the tune of Rs.85,00,000/ by the applicants with the
Complainant
Shankar
Dhanwate.
He
submits
that
out
of
Cri. Bail Appln. No.582 of 2022 (Or. Exh.1)

Rs.85,00,000/, they had paid 82,00,000/ rupees to the complainant.
He further submits that the said Shankar Dhanwate had filed a
complaint application to the Commissioner of Police, Nashik, who in
turn forwarded the same to the NashikRoad Police Station and Police
of the NashikRoad Police Station are threatening the applicants that,
they should settled the grievance of the complainant by making the
outstanding payment otherwise they will register a Crime against the
applicants. He further submits that, the applicants are called by way of
telephonic calls by the respondent/police and if the applicants
approached them, there is an apprehension that the applicants will get
arrested. Therefore, prayed that interim protection be granted and
notice be issued to the respondent or they may be directed that, if the
Crime is registered on the compliant application of Shankar Dhanwate
against the applicants, then 48 hours notice be directed to be given to
the applicants before their arrest.

Upon hearing and going through the material placed on
record, this Court finds that by issuing certain directions, the main
application can be disposed off, instead of issuing notice to the
respondent and calling their say as till dates the Crime is not registered.
The Police are calling the applicants for the purpose of inquiry of the
compliant application, which they have received. Therefore, this Court
proceeds to pass the following order.
ORDER
1.
Criminal Bail Application No.582 of 2022 stands disposed off as
under :
(a)
In the event of registration of Crime by the Respondent/Nashik
Road Police Station on the complaint application of Shankar
Dhanwate, respondent to give a 48 hours notice to the applicants
before their arrest.

(b)
Inform the said order to the Respondent/NashikRoad Police
Station.
(c)
Applicants to cooperate in the inquiry of the complaint
application by appearing before the Respondent/Police Station
as and when they call for inquiry.

stands disposed off accordingly.
