The applicant/accused Mayur Balu Dukare claims
bail in C.R. No. I­126/2022 for the offences punishable under
Sections 342, 376 of the Indian Penal Code and under Sections 4,
6 & 8 of the POCSO Act registered with Wavi Police Station.

Heard Learned Advocate Shri P.R.Kalantri, for the
applicant and learned A.P.P. Smt. Jadhav for the State. Perused
the papers of investigation.

It is the case of the prosecution that applicant has
committed forceful rape upon minor victim.

On perusal of report, it reveals that the incident
occurred on 04.06.2022.
be lodged.

On the very same day, report came to
Applicant came to be arrested on next day.

There
are averments in the report that the applicant and informant are
acquainted with each other. He came to the house of informant
and then committed alleged act. But then, ld. Advocate for the
applicant produced bunch of Whats­App chat between applicant
and informant which indicates that they were engaged in love­
affair.

There are no allegations that the applicant acted
violently against the informant. Medical report of the informant
is silent on that aspect.

The present applicant is a young boy of 21 years old.

He came to be arrested on 05.06.2022.

There is no any recovery
or discovery as such remained from the applicant.

According
to ld. Advocate for the applicant, the applicant has no criminal
antecedents.

He is a local resident and is ready to abide any
conditions on grant of bail.

Considering all these aspects, this
Court is of the view that applicant can be released on bail by
imposing certain conditions. Hence the order.

Applicant­Accused Mayur Balu Dukare

Rs.15,000/­(Rupees Fifteen Thousand only)
