claims bail in C.R. No. I­254/2022 for the offences punishable
under Sections 304(B), 498­A), 323, 504, 506 r.w. 34 of the Indian
Penal Code
registered with Mumbai Naka Police Station,
Nashik.

Heard Learned Advocate Shri A.S. Deshmane, for the
applicant and learned A.P.P. Mr. Kotwal for the State. Perused
the papers of investigation.

It is the case of the prosecution that the applicant
harassed the deceased for unlawful demand, treated her with

physical and mental cruelty and thereby abetted/instigated the
commission of suicide by her.

On perusal of record it reveals that there are specific
allegations against the applicant that he used to abuse the
deceased by physically and mentally illtreating her. Prima facie
concerned of the applicant with the alleged offence is thus
become clear from the avernments in the report. Though the
other accused are released on bail, their role is different than the
role of present applicant in connection of alleged crime.
Therefore, ground of parity will not be applicable to the
applicant. The offence allegedly committed by the applicant is
very much serious in nature. Thorough investigation is required
to be done. Investigation is in progress, therefore at this stage
this court of the view that the applicant is not entitle for the
relief claimed. Hence, the order.

The application (Exh.1) stands rejected.
